In this case the plaintiff attempted to recover on behalf of Jane Phelps and the decedent's estate the sum of $129,000, as benefits under a life insurance policy purportedly taken out by the decedent on the life of his daughter, Linda Phelps, in which he named the plaintiff as the beneficiary of the proceeds of the policy and then subsequently changed the beneficiary of $129,000 to Jane Phelps. The insurer paid the proceeds of the policy to the insurer and then sued Jane Phelps and her estate, alleging, in the alternative, conversion or unjust enrichment. The plaintiff, in a verified complaint, alleged fraud and stated as follows: "10. The said Defendants herein, Fred Phelps, II and Charlotte Insurance Company and/or George S.
